First Degree Sexual Assault is a felony offense.
pregnancy or great bodily harm
Under Wisconsin laws, any person who has unconsented sexual contact or sexual intercourse with another person and causes pregnancy or great bodily harm is guilty of a Class B Felony offense.
sexual assault of a minor child under 13 years of age
Any person who has sexual contact or sexual intercourse with a minor under the age of 13 years is subject to the penalties of a First Degree Sexual Assault of a Child, a Class B Felony offense.
repeated acts of sexual assault of same child
If a person is accused of having sexual contact or sexual intercourse with a child on at least three occassions during a specific time period, and the prosecution is able to prove to the jury or judge that such sexual assaults occured, then the conviction will be for a Class B Felony. If less than three sexual assault can be proven, then the conviction will be for a Class C. Felony.
sexual assault with a dangerous weapon
Under Wisconsin laws, any person who has unconsented sexual contact or sexual intercourse with another person by use or threat of use of a dangerous weapon or any article used or fashioned in a manner to lead the victim to reasonably believe it to be a dangerous weapon is guilty of a Classs B Felony offense.
sexual assault by use or threat of force or violence
Under Wisconsin laws, any person who is aided or abetted by one or more other persons and has unconsented sexual contact or sexual intercourse with another person by use or threat of force or violence is guilty of a Class B Felony offense.
