Under common law principles, a child under the age of seven years was deemed to be incapable of forming the necessary mens rea (a culpable mind) to commit a crime. A child between the ages of seven years and fourteen years held a presumption of excuse (the prosecution could rebut the presumption). Over the age of fourteen years, a child was deemed capable of forming the necessary mens rea and standing trial as either a child or an adult, depending upon the circumstances of the crime for which she was accused.
