Duress

Duress is an excuse defense to a lesser crime.

Under common law principles, generally speaking, a defense of duress relieves the defendant of criminally liability for crimes other than homicide in which the defendant was not the instigator and for which the defendant reasonably believes he had no other alternative than to commit the crime in order to prevent another person from inflicting death or great bodily harm on the defendant. In a minority of jurisdictions, the defendant would be permitted to assert the defense of duress if his own life was in danger and a reasonable person would have made the same choice to commit a homicide. However, the threat of death by a third party does not excuse the defendant's intentional homicide.
