Larceny By Trick

Larceny by trick is taking possession of the personal property knowingly owned by another with the intent to permanently deprive the owner of that property, by fraudulently inducing the victim to deliver possession of that property. The owner's consent is nullified by the fraudulent inducement.

Possession

Larceny by trick is the taking of possession, not title (the acquisition of title through factual misrepresentation is the crime of false pretenses).

Intent To Permanently Deprive

In some jurisdictions, to sustain a charge of larceny by trick, the intent to permanently deprive must have existed at the time of the induced delivery; however, in other jurisdictions, the fraudulent inducement is a continuing trespass until such time that the intent to permanently deprive is formed at the time of the taking, therefore any subsequent misappropriation results in a larceny by trick.

Fraud

Fraud usually is substantiated by proof of factual misrepresentation and false promises (a promise made with the intent to break it (as opposed to broken promises, which are promises made with the intent to keep them)).
