Kidnapping

Kidnapping is the false imprisonment of a person through the intentional and unlawful restraint of that person against his will and without his consent with restraint or prevention of escape and the movement of that person from one place to another place.

False Imprisonment

Under common law, kidnapping is false imprisonment plus movement of the victim from one place to another.

Kidnapping Movement Requirement

Kidnapping is the intentional confinement of a person without consent and without a means of escape or the threat of constraint or force (false imprisonment) and a movement of the victim from one place to another place.

At common law, in most jurisdictions, in order to sustain a charge of kidnapping, the kidnappers must move the victim substantially. In other words, movement from one room to another room that is not concealed will likely be false imprisonment if the victim is restrained or all means of escape are prevented by the captors. Conversely, kidnapping requires that the movement of the victim be of a substantial distance, such as from one home to another home, or one city to another city.

In a minority of jurisdiction, the kidnapper must have an ulterior motive such as to seek a random or commit some other felony, and absent that motive, the charge is usually aggravated false imprisonment.
