Once the jury is selected for a criminal trial, the court will determine if the jurors may take notes and if so, provide the materials and instructions on note-taking, including that the notes will be collected at the end of the trial and destroyed. The court will inform the prosecution and defense of the instructions it intends to provide to the jury so that each party has the opportunity to object to the information and to suggest additional instructions as they see proper. The court will then provide the jury with this information and instruction, which may include the elements of a criminal charge, what constitutes evidence, the burden of proof, creditability of a witness, and a directive to refrain from discussing the case until deliberations commence.

At the conclusion of a criminal trial, the court delivers jury instructions to the jury. Those instructions include a reading of the law that applies to the charges alleged against the defendant and an interpretation of the law to the extent allowed by statutory law. Prior to the delivery of the jury instructions, the prosecution and the defense may each submit a motion to the court requesting that certain insturctions be given to the jury. The court informs the defense and prosecution attorneys of the instructions that the court intends to deliver. Usually, the entire set of instructions that the court intends to provide to the jury are taken from the volumes of "Jury Instructions" manuals created for use by Wisconsin courts. The defense attorney or the prosecutor may object to the court's intended instructions. The process of determining which instructions are to be given to the jury is a matter that is often times appealed.

Once the jury instructions are given, the jury goes into deliberation. The jury may from time to time ask the court to clarify the instructions that they were given or to provide access to evidence presented during the trial. For any requests, both the prosecutor and the criminal defense attorney are made aware of the request.
