Van Wagner & Wood - “Double Jeopardy”

We have a constitutional rule against being subjected to “double jeopardy”. This means, simply, that once the state prosecutes you for a crime, they may not do so a second time if you are found not guilty. Although there are limits on this principle, it is exceedingly rare to be tried, found not guilty, and tried again for charges arising out of the same facts.

Thus, when a jury trial begins, that is , when the jury selection is completed and the jury is sworn, it is said that “jeopardy attaches”. From that time forward, the State may try you but once for the same crime.
