The Burden of Proof Beyond A Reasonable Doubt

In a criminal case, before a verdict of guilty can be returned, the prosecutor must present evidence that convinces the jury hearing the case (or the judge, in a court trial) that an accused defendant is guilty "beyond a reasonable doubt." Although this standard seems to be a difficult one to meet, in fact, juries regularly reach verdicts of guilty in criminal cases. This means that although in the eyes of the law, we are all “innocent until proven guilty”, the reality is that an accused person is often assumed guilty, and often needs to prove his innocence to a jury in order to avoid a mistaken conviction.
