Appeals - State & FederalWhen a person is found guilty of a crime, the law refers to the guilty verdict as a conviction. If a person is convicted of a crime, the court imposes a sentence. An appeal of a conviction is a request made to a higher court to review the conviction. An appeal can ask for review of procedures, as well as the sentence imposed, particularly if that sentence is exceeding long given the crime. Automatic AppealsWisconsin is an automatic appeal state, which means that anyone who is convicted of a serious offense for which the penalty is prison has a right to an appeal. Some states do not provide automatic rights to appeals. The automatic right to appeal should not be confused with an automatic overturn of the lower court's opinion. Overturned On AppealWhen a case is overturned on appeal, it simply means that the appellate court did not agree with the lower court's findings, the procedures followed during the trial, the sentencing imposed upon the convicted defendant, or some other reliance upon case law or facts involved in the case. An overturn does not mean that a previous conviction is automatically reversed. For example, a case can be granted an appellate hearing, be heard by the appellate court, be overturned, be rermanded to the lower court for further proceedings consistent with the findings of the higher court, and still result in the court finding the defendant guilty.
