Homicide Of A Homicide Victim

Under common law principles, a defendant can only be the proximate cause of a criminal homicide of a victim who is not already dead. If the defendant's act or actions were not the cause of death, the defendant is not the cause-in-fact.

Homicide Of A Terminally Ill Victim

At common law, if the defendant's acts bring about the death of a person who is terminally ill, regardless of whether the ensuing death is expected within minutes or years, criminally liability attaches, so long as the defendant's acts were the cause in fact of the resulting criminal homicide. If the actor planned and considered (called premeditation and deliberation) the act before committing it, the state may charge the actor with murder, which in the state of Wisconsin is charged as first-degree intentional homicide.
