Shocking Acquittals (Not Guilty Verdicts)
Driver found Not Guilty of Negligent Vehicular Homicide, Hit-and-run
Homicide
A jury deliberated for nearly three hours late Friday in
Marquette County Circuit Court before turning in not guilty verdicts on
all counts. Jon Salm, represented by Attorney
Chris Van Wagner, had been charged with two counts of criminal negligent
homicide and two counts of hit-and-run causing death by use of a dangerous
weapon. His twin brother, Brian Salm, of Neshkoro was acquitted of two
counts of being a party to hit-and-run.

Man Cleared of First-Degree Intentional Homicide Charge
Jurors deliberated for less than two hours Friday before
finding Edgar Covarrubias, 20, not guilty of attempted first-degree intentional
homicide and endangering safety... "We are not just happy,"
Chris Van Wagner said. "We
are relieved."

Jury's Not Guilty Verdict in Admitted Shooting Case Shocks Community
Not since the O.J. Simpson trial has a defendant found a
more believing jury. On the charge of first-degree homicide, the 12 jurors
could not reach a unanimous decision. On the much less serious charge
of negligent handling of a dangerous weapon, the jury found Meng not guilty
even though he virtually admitted as much himself... "The jury believed
what Bob Meng told them about the shooting and that he lied to police
when he was arrested," Meng's attorney (Chris Van Wagner) said moments
after the verdict was announced. Obviously so.

Former DA Found Not Guilty of Attempted First-Degree Intentional Homicide

declined the invitation, but the two men clasped each other around the
back as Dane County Circuit Judge Patrick Fiedler read verdicts that exonerated
Staton of charges of attempted first-degree intentional homicide and first-degree
reckless injury for the March 8, 1998, shooting of DeeAnn Foust. "I
feel that justice was done,'' said Staton, standing in a courthouse hallway
shortly after the jury returned its verdict in the case. "Chris did
a hell of a job. He said a long time ago we would win, but you just never
know.'' Madison attorney Wayne Staton came within a hair's breadth of
getting tossed into jail for contempt of court as he continually interrupted
a judge during yet another request for a postponement of his attempted
murder trial.

Staton Verdict:
"I feel justice was done. I think Chris
[Van Wagner] did a helluva job," Staton said later. He retained
his composure when the verdicts were read, while Van Wagner bowed his
head, suppressing an exultant grin. Staton patted Van Wagner's cheek,
as if to soothe him, then peered over his glasses at departing jurors.

Man Cleared in Theft of Tanks and Missile Launchers from Ft. McCoy
In the nationally known Fort McCoy vehicle theft cases,
Attorney Tracey Wood was one of only
two attorneys to secure an acquittal. Nine men were prosecuted for the
tank thefts.

been convicted of two DUI offenses in another state to establish that
a current offense in Wisconsin would be his third, Attorney Tracey Wood,
in a successful argument to the Court of Appeals, proved the Prosecutor
wrong and achieved having the trial court's sentence reduced to the lesser
penalties of a first offense DUI.

Waived Rights Regained: DON'T GO IT ALONE

Eller waived her right to a jury trial before she waived
her right to counsel. When the court explained to her that she would be
held to same standards and expected to possess the same knowledge that
an attorney would be in a case, she reconsidered and asked for a Public
Defender. The court proceeded on her waiver of a jury trial and found
her guilty of a third offense of drunk driving. She then consulted with
Attorney Tracey Wood, who argued to
the Court of Appeals that her case was not tried fairly; the Court of
Appeals agreed, reversed the trial court's decision, and instructed the
trial court to hold a new trial.

DUI Charges? Wood Speaks Out : Backlog At State Lab Stalls Criminal

"In cases of alleged 'operating a motor vehicle while
under the influence of a controlled substance or combination of controlled
substance and alcohol,' there can be a wait of six months or more,"
said Madison criminal defense Attorney Tracey Wood. "That puts a
huge stress on the system because cases are dismissed and then recharged
when the test results come back," Wood said. "By that time,
memories have faded regarding the incident, and the case is a lot tougher
for both the prosecution and defense. There's also the chance that the
case can get lost in the shuffle and never be prosecuted."

A collateral attack of a prior conviction is not an appeal of that conviction;
it is simply a mechanism for defense attorneys to use to prevent the prior
conviction from enhancing the penalties the clients faces in the current
case. For example, if you, the defense attorney, are representing a person
charged with fifth offense OWI (a felony), and you discover the client
did not have an attorney or waive counsel in his fourth offense case,
he should be sentenced as a fourth offense misdemeanant, as opposed to
a fifth offense felon. The conviction for fourth offense OWI will remain
on his record, but it cannot be used for sentencing purposes if it is
properly challenged.

Woman Pleads No Contest In Childcare Case

At Tuesday's plea hearing in Jefferson County Circuit Court,
the prosecution D. Mattsen dropped seven of the eight counts against Mattsen
of failure to stop the abuse. Mattsen's lawyer, Attorney Tracey Wood,
said the plea was the best resolution for both the state and the defense.
